if you drive in the rain or in rainy conditions then i would get the bypass. i tested them out. i parked over a puddle and started to rev the engine. and i took off the cold air intake and the pipe was wet inside. i installed the Bypass valve and did the same thing same puddle about 2 mintes later and the pipe was completely dry. the bypass is alittle thicker cloth then the air filter so it only sucks in when there is pressure at the filter. pressure caused by water.
for your second answer when you drive in the rain you will feel it alittle sluggish but very very little but in the dry weather your CAI will perform like if the bypass was never there.
i know i would have like 4 engines thrown out back without the bypass and when i dont have a bypass i dont risk it and just go short ram till i can get one. also make sure you get a K&N filter they allow better breathing. but you have to also remember if you are letting more air into the engine you need to let more air out of the engine so when you get a cold air intake you will get even better response with some headers and an exhaust system. otherwise you are allowing to much air in and not enough airflow out this wont damage your engine but it will damage performance that it puts out. any 4-2-1 headers will be good even nonamed headers and if you cant get a full exhaust i always went to jegs.com and went to mufflers and order the 31" thrush magnum glasspack it should have a 2 1/4 inlet and outlet and have a muffler shop make a 2 1/4 exhaust for you. the glasspack is a resonator it cuts sounds to the straight through piping but still allows full air flow. and it cost about $31 for the resonator and a shop will make the exhaust for about 60-80 with resonator installed. it will sound clean and deep. and it will give you a better accelleration
